2. Data Collection & Processing
We collect and process personal data only to the extent necessary to provide our brand identity and positioning services. Data collected includes: name, email address, phone number, company name, and project-related information submitted through our contact form or direct communication.
Legal basis for processing: Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(f) GDPR (legitimate interest in providing brand strategy services).
3. Data Storage & Retention
Personal data is stored on servers within the European Economic Area (EEA). Data is retained for the duration of the business relationship and for up to 6 years thereafter, in compliance with German commercial and tax record-keeping obligations (§257 HGB, §147 AO).
4. Data Sharing
We do not sell, rent, or trade personal data. Data may be shared with: hosting infrastructure providers (within the EEA), payment processors (Stripe, for transaction processing only), and legal advisors when required by law.
5. Your Rights (GDPR)
Under the General Data Protection Regulation, you have the following rights: Right of Access (Art. 15), Right to Rectification (Art. 16), Right to Erasure (Art. 17), Right to Restriction of Processing (Art. 18), Right to Data Portability (Art. 20), and Right to Object (Art. 21).

6. Data Security
MarketBrandCraft implements appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. This includes TLS encryption for data in transit and encrypted storage at rest.
Terms of Service
Effective Date: January 1, 2026
1. Scope of Services
MarketBrandCraft provides brand identity, brand positioning, visual identity design, brand narrative development, and related strategic services as described in individual service proposals and statements of work. All services are delivered from our office at Wendelinusstr. 3, 64646 Heppenheim, Germany.
2. Contract Formation
A binding contract is formed upon written acceptance of a proposal by the client, or upon commencement of work following a verbal or electronic agreement. Proposals are valid for 30 calendar days from the date of issuance.
3. Pricing & Payment
All prices are quoted in Euros (EUR) and are exclusive of VAT unless otherwise stated. Payment is due within 14 days of invoice date. Late payments accrue interest at 5 percentage points above the ECB base rate per annum, in accordance with §288 BGB.
For projects exceeding €2,000, a 50% advance payment is required before work commences. Remaining balance is due upon delivery and acceptance of the final deliverables.
4. Intellectual Property
Upon full payment, all rights to final deliverables (logos, visual identity systems, brand guidelines, copy, and design assets) are transferred to the client. MarketBrandCraft retains the right to display work in portfolios and case studies unless the client objects in writing.
Work-in-progress materials and draft concepts remain the intellectual property of MarketBrandCraft until final acceptance and full payment.
5. Revisions & Approval
Each service package includes a defined number of revision rounds as specified in the proposal. Additional revisions beyond the included rounds are billed at €120 per revision round. Client approval of deliverables constitutes acceptance of the work product.
6. Limitation of Liability
MarketBrandCraft's total aggregate liability for any claim arising from or related to the services shall not exceed the total fees paid by the client for the specific service giving rise to the claim. MarketBrandCraft shall not be liable for indirect, consequential, or incidental damages.
7. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for any disputes shall be Frankfurt am Main, Germany.
Refund & Reimbursement Policy
Effective Date: January 1, 2026
1. General Refund Terms
MarketBrandCraft is committed to delivering high-quality brand identity and positioning services. Refunds are evaluated based on the stage of project completion and adherence to the agreed-upon scope of work.
2. Advance Payment Refund
If a project is cancelled by the client before work has commenced, the 50% advance payment will be refunded in full within 14 business days. If work has commenced, the advance payment is non-refundable and is applied toward work completed to date.
3. Milestone-Based Refunds
For projects structured around milestones, refunds for undelivered milestones will be processed within 14 business days of cancellation request. Delivered and accepted milestones are non-refundable.
4. Non-Refundable Items
The following are non-refundable: (a) Work that has been delivered and approved by the client; (b) Third-party costs incurred on behalf of the client (stock imagery, font licenses, printing); (c) Revision rounds exceeding the agreed scope, which are billed separately.
5. Dispute Resolution
In the event of a dispute regarding refund eligibility, MarketBrandCraft will first attempt to resolve the matter through direct communication. If a resolution cannot be reached, the parties agree to mediation before initiating legal proceedings. The place of jurisdiction for unresolved disputes is Frankfurt am Main, Germany.
6. How to Request a Refund
Refund requests must be submitted in writing to [email protected] with the subject line "Refund Request — [Project Name]". Requests are processed within 5 business days of receipt. Approved refunds are issued via the original payment method within 14 business days.
